Notice and disclosure for photographs and video

Pursuant to Article 13 Regulation (EU) 2016/679

“General Data Protection Regulation”

and Article 96 of Italian Law no. 633 of 22 April 1941

Pursuant to Article 13 of the General Data Protection Regulation (the “GDPR”), Fondazione Penta ETS, an organization incorporated in Italy (Fiscal Code 92166930286) whose registered office is in Padova, Corso Stati Uniti, 4 ( “Penta”, “we”, “our”, “us” or the “Foundation”), in its capacity as Data Controller, provides you with the following information on the processing of your personal data. The personal data processing will be carried out in compliance with the GDPR, the Italian Legislative Decree n. 196 of 30 June 2003 “Italian Personal data protection Code” and Article 96 of Italian Law no. 633 of 22 April 1941 (the “Italian Copyright Law”).

We inform you that your personal data (photo, video, voice, name, surname and professional role) will be processed to allow the creation, printing for the public and possible dissemination on our digital channels and printed materials (e.g., Penta’s websites and social channels) of informative and promotional material relating to our activities (the “Material”). The Material could also be communicated to newspapers (including online) and to our partners belonging to the research and healthcare sector, for the same purpose of promoting Penta’s activities.

The processing of your personal data for the purposes indicated above is optional and based on your consent (Article 6, par. 1, let. a), of the GDPR). In case of refusal, Penta may not use your personal data for the purpose listed above. Your consent is freely revocable, without prejudice to the lawfulness of the processing prior to revocation, by writing to legal@pentafoundation.org.

Within the scope of the purpose above, your personal data will be processed, both on paper and electronically, in compliance with the legislation in force and in any event in such a manner as to ensure their security and confidentiality. Your personal data could be accessed only by persons authorized to the processing and/or by the company in charge of the creation of the Material and/or which supports us in the management of our IT services. By writing to legal@pentafoundation.org you can revoke your consent at any time and your personal information will be deleted from Penta’s systems. In any case, your personal data will not be stored by Penta for a period exceeding 5 years from the creation of the Material.

Your personal data might be the subject to transfer to countries not belonging to the European Union to achieve the aforementioned purposes. The transfer of personal data will take place in full compliance with the guarantees, measures, and rights provided by the GDPR, usually based on the standard contractual clauses approved by the European Commission. By sending an email to legal@pentafoundation.org, you can receive further information regarding the transfer of your personal data and the guarantees in place for their protection.

Through a communication to be sent to legal@pentafoundation.org, you may at any time exercise the rights referred to in Articles from 15 to 22 of the GDPR, including obtaining access to your personal data, correcting inaccurate personal data or deletion or limitation thereof, asking to receive, or sending your data to another controller in a structured, commonly used and readable format from an automatic device. We remind you that, if you believe that the processing of your data violates the provisions of the GDPR, you may at any time submit a complaint to the Italian Data Protection Authority for the protection of personal data (www.garanteprivacy.it) or, if different, to the Data Protection Authority of the country in which you reside habitually, work or, lastly, of the place where the alleged violation occurred.
